YMBL BACKGROUND CHECK AND PRIVACY POLICY

The Young Men’s Business League (“YMBL”) founded the Austin YMBL Sunshine Camps (“ASC”), a 501(c)(3) dedicated to the goal of “strengthen[ing] ‘at-risk’ youth against those things that threaten their health—mental and physical.” ASC strives year-round to accomplish this goal through the dedication of YMBL members, YMBL and ASC employees, as well as volunteers of the Austin community at-large, all of whom are committed to devoting their time, energy, and resources to the children and adolescents served by ASC (“ASC Participants”).

To protect the health and safety of the ASC Participants, the Board of Directors of YMBL/ASC has implemented a policy requiring all YMBL Members to submit to background checks at the time of their joining YMBL and at least annually thereafter upon renewal of their memberships. The background checks may include, but are not necessarily limited to, investigation into criminal records, sexual predator databases, and driving records (collectively, “Background Check”).

YMBL members and prospective members shall consent to YMBL’s collection of information regarding the individual’s identity and background, and provide such information to YMBL upon request. Requested information may include the individual’s name, address(es), telephone number(s), date of birth, and the last four digits of the individual’s Social Security Administration Number (“SSAN”) (collectively, “Identification Information”). Individuals may withhold their dates of birth or SSANs; however, YMBL reserves the right to exclude such individuals from membership in YMBL, as well as any and all interaction with ASC Participants, and/or participation in volunteer opportunities with ASC.

YMBL members shall consent to YMBL’s use of their Identification Information to perform Background Checks to assess their respective fitness for membership in YMBL and for the provision of volunteer services to ASC. Satisfactory Background Checks, as determined by the YMBL/ASC Board of Directors in its sole discretion, shall be required before any YMBL Member may interact with any ASC Participants. YMBL reserves the right to repeat such Background Checks at any time.

YMBL values the privacy of members and applicants. YMBL shall maintain in strict confidence Identification Information and the results of Background Checks and shall not intentionally disclose any such information to any third party unless required by law. YMBL may engage a third party service provider to perform the Background Checks referenced herein, subject to agreement by the third party service provider to maintain as strictly confidential the results of the Background Check and any Identification Information provided. All Identification Information collected by YMBL shall be retained in files secured with functioning locks, the access to which shall be limited to the Executive Director. Dates of birth and SSANs are not stored in electronic form by YMBL, shall not be disseminated to the media, nor published on the YMBL or ASC web sites. The Executive Director of YMBL is responsible for conducting Background Checks and retaining files verifying that the Background Checks have been completed. YMBL shall never sell to any party the contents of Background Checks or any Identification Information collected. The contents of Background Checks and Identification Information shall be retained for only so long as is necessary, as determined by the YMBL/AS Board of Directors in its sole discretion, for YMBL to protect the health and safety of ASC Participants. At such time as such Identification Information is no longer required by YMBL to protect the health and safety of ASC Participants, the contents of Background Checks and Identification Information shall be destroyed.

Any questions or concerns regarding the YMBL Background Check and Privacy Policy should be directed to membership@austinymbl.org.

ACKNOWLEDGMENT AND CONSENT

I, the undersigned, have received, read, and understand the YMBL Background Check and Privacy Policy. I understand that the Young Men’s Business League (“YMBL”) has implemented this policy to protect the health and safety of the children and adolescents served by the Austin YMBL Sunshine Camps (“Participants” served by “ASC”) which YMBL owns and operates.

I understand that the policy requires YMBL Members to consent to YMBL’s collection of personal identification information and to submit to background checks, including investigation into criminal records, driving records, and sexual predator databases (“Background Checks”).

I understand that my membership in YMBL and my interaction with Participants is contingent on YMBL’s determination, in its sole discretion, of my fitness for membership in YMBL and/or volunteer services to ASC as determined through YMBL’s investigation of my background. I understand that YMBL may use my name, address, telephone numbers, date of birth, and the last four digits of my Social Security Administration Number to conduct its investigation into my background. I understand that, as long as I am a member of YMBL, such investigations into my background may be repeated at any time by YMBL with or without notice to me.
